The High Court has rejected an attempt to halt Chiltern Railways' plan to provide a new rail service from London Marylebone to Oxford, via Bicester.

The court turned down the bid by North Oxford resident Sean Feeney to stop the Evergreen 3 project.

“We welcome the High Court decision confirming that Chiltern Railways has the necessary powers to build a new rail route between Oxford and London Marylebone," said Graham Cross, director of Chiltern Railways.

“Through this project, Chiltern Railways will open the first new rail link between two major British cities for 100 years with the line expected to deliver significant economic benefits for those living and working along the route.

“Towns and villages to the north of Oxford will gain especially from improved rail access and a new parkway station for the region.

“In addition, the fast growing town of Bicester will enjoy an additional link to the capital adjacent to Bicester Village Shopping Centre. The project will also see the re-establishment of long lost rail links, such as between High Wycombe and Oxford.

“Chiltern Railways plan to open the line and operate services from Oxford’s new parkway station close to Water Eaton from the summer of 2015 with the full line to Oxford expected to open in spring 2016.

“Construction work will begin this summer with the line between Bicester Town and Oxford expected to close in February 2014. Passengers should be reassured that 12 weeks notice of the line closure will be given.”

The High Court hearing was on 19 March 2013 and judgment was given on 17 May 2013 by Mr Justice Ouseley.
